1. Acceptance of Terms
By accessing or using the website of Lucketts Asphalt LLC ("the Company"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and all applicable laws and regulations of the Commonwealth of Virginia.
2. Estimates, Proposals & Contracts
All estimates, interactive volume calculators, and preliminary proposals provided via this website are estimates only and do not constitute a binding legal contract until a formal written construction agreement is executed by both Lucketts Asphalt LLC and the client. Final contractual pricing is subject to physical subgrade inspection, laser grade confirmation, and agreed material specifications.
3. Site Access & Utilities
For all scheduled on-site paving, concrete, and demolition projects, clients agree to provide unobstructed property access for heavy trucks, asphalt pavers, and excavators. Clients must ensure that private underground sprinklers, buried pet fences, and unmapped private utilities are marked prior to excavation. Public utility marking is conducted in accordance with Virginia 811 Miss Utility guidelines.
4. Intellectual Property
All content on this website—including business trade names, logos, original project photography, copy, and layout design—is the exclusive intellectual property of Lucketts Asphalt LLC and protected by copyright law.
5. Limitation of Liability
In no event shall Lucketts Asphalt LLC, its owner Raul Huizar, or its employees be liable for any indirect, incidental, or consequential damages resulting from website downtime, delays due to adverse weather conditions, or unforeseen underground subgrade anomalies discovered during excavation.
6. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any legal disputes shall be brought within the state courts located in Frederick County / City of Winchester, Virginia.
